Twelve Days of Shine® Giveaway Terms and Conditions
Effective Date: December 1st, 2023
Car Wash Partners, LLC dba Mister Car Wash® (“Sponsor”) will accept entries for the one or more separate holiday giveaway(s) each day of the period beginning on December 1, 2023 and ending on December 12, 2023 (the “Giveaway Period”) as part of Sponsor’s Twelve® Days of Shine Giveaway (each giveaway being, a “Sweepstake”) as posted on @mistercarwashhq (“Instagram Account”) in accordance with the entry rules (“Rules”) set forth on the Instagram Account for such Sweepstake and generally in these Twelve Days of Shine® Giveaway Terms and Conditions (“Terms”). By participating in a Sweepstake in any way, specifically by submitting an Entry (defined below), each Entrant (defined below) agrees to abide and be bound by the Rules and these Terms.
NO PURCHASE IS NECESSARY TO ENTER OR WIN:
No purchase is necessary to enter or win and a purchase will not increase your chances of winning or being selected in a Sweepstake.
ELIGIBILITY:
Each Sweepstake is open to persons who are legal residents of, and physically located within, the United States of America, age 18 or older at the time of Entry. Void where prohibited. All federal, state, and local laws and regulations apply. Employees of Sponsor are not eligible to enter or win any Sweepstake or receive any Prize (as defined below). Entrants that have won a Prize in any Sweepstake of the 12 Days of Shine Giveaway are not eligible to enter or win any Sweepstake or receive any Prize in any subsequent Sweepstake of the 12 Days to Shine Giveaway. Entrants that have won a Prize in a particular Sweepstake of the 12 Days of Shine Giveaway are not eligible to win more than 1 Prize in such particular Sweepstake.
ENTRY PERIOD:
The entry period for each separate Sweepstake (“Entry Period”) begins as specified in the Rules for such Sweepstake posted on the Instagram Account but no earlier than at 12:00 am Mountain Standard Time on each day of the Giveaway Period and ends at 11:59 pm Mountain Standard Time of the same day.
HOW TO ENTER:
During the Entry Period for each Sweepstake, an: “Entrant” may visit the Instagram Account and follow the Rules provided to complete the “Entry”. There is no limit to how many times a person can enter each Sweepstake during the applicable Entry Period. To be valid, each Entry must be received by 11:59 pm Mountain Standard Time on the final date of the Entry Period for the applicable Sweepstake (“Entry Deadline”). Any Entry generated by script, macro, artificial intelligence, LLM, or similar service or other automated means will be void.
By submitting an Entry to a Sweepstake, each Entrant agrees that such Entry conforms to the Rules for that Sweepstake and these Terms and that Sponsor, in its sole discretion, may disqualify an Entrant and/or Entry for any reason, including, but not limited to, that an Entry fails to conform to the Rules of the applicable Sweepstake and these Terms or otherwise contains unacceptable content, as determined by Sponsor in its sole discretion.
PRIZE:
Each selected Winner will win the giveaway specified in the Rules of each Sweepstake (“Prize”). The giveaway of one Unlimited Wash Club® Platinum membership is governed by the .
ENTRY REQUIREMENTS & RESTRICTIONS:
Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:
Is sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane, pornographic, or contains nudity;
Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, any particular political agenda or message;
Is obscene or offensive, endorses any form of hate or hate group, or appears to duplicate another Entry;
Defames, misrepresents, or contains disparaging remarks about other people or companies;
Contains any personal identification, such as license plate numbers, e-mail address, or street address;
Contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures including look-alikes, living or dead, without permission;
Violates any law.
Any failure to conform with these Terms may result in disqualification of an Entry.
SELECTION OF WINNER(S):
Each Entry, subject to the “Eligibility” requirements of these Terms, received by Sponsor during the applicable Entry Period of a Sweepstake in accordance with the Rules and these Terms will be considered. One or more “Winner(s)” (number of which will be specified in the applicable Rules for each Sweepstake) will be chosen at random by Sponsor within ten (10) business day of the Entry Deadline.
WINNER(S) NOTIFICATION:
Within thirty (30) days following the Entry Deadline, each Winner will be notified by Direct Message at the Instagram profile name provided on such Winner’s Entry. Each Entrant is solely responsible for informing Sponsor of any changes of such Entrant’s Instagram profile name.
LICENSE & USE OF ENTRY:
By submitting an Entry, Entrant hereby grants permission for Entry to be used, reproduced, or posted on any of Sponsor’s websites or social media accounts, including but not limited to www.instagram.com/mistercarwashhq, other websites or social media sites, and other uses whether or not expressly set forth herein. Entrant agrees that Released Parties (defined below) are not responsible for any unauthorized use of Entry by third parties. Released Parties do not guarantee the posting of any Entry and reserve the right to take down any Entry at any time.
By submitting an Entry, each Entrant agrees Sponsor shall have a non-exclusive, perpetual, irrevocable, royalty-free, full paid-up license to the Entry submitted (including all rights embodied therein) and that Sponsor, and their respective designees may exploit, edit, modify, post, creative derivatives work of and distribute the Entry and all elements of such Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, including for advertising and marketing their products and services, worldwide, without compensation or notification to, or permission from, any Entrant or any third party.
PRIVACY:
Each Entry will require Entrant to provide personal information. Use of personal information shall be subject to the privacy policy of Sponsor (the “Privacy Notice”), which is available at https://mistercarwash.com/privacy-policy/ (“Privacy Notice”). Any information an Entrant provides as part of a Sweepstake will be treated in accordance with the Privacy Notice as if the Entrant were a customer. Notwithstanding the Privacy Notice, except where prohibited, participation in the Sweepstake constitutes an Entrant’s consent to Sponsor’s use of Entrant’s name and/or likeness for programming, advertising, publicity, and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its affiliates or designees, without compensation (unless prohibited by law) or additional consents from an Entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. By participating, an Entrant also agrees not to release any publicity or other materials on their own or through a third party regarding their participation in one or more Sweepstakes without the prior consent of the Sponsor, which may be withhold in Sponsor’s sole discretion.
LIMITATION OF LIABILITY:
Sponsor and its respective affiliates, subsidiaries, parent, advertising and promotion agencies, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, “Released Parties”) are not responsible for: any incorrect or inaccurate Entry information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in a Sweepstake; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to an Entrant’s or any other person’s computer or other property relating to or resulting from participation or any attempt to participate in any Sweepstake; inability to access the Instagram Account; theft, tampering, destruction, lost, or unauthorized access to, or alteration of an Entry; any Entry that is processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any Entry which is late, lost, incomplete, misdirected, stolen, or any combination thereof. Online submission is not considered proof of delivery or receipt. Each Entry becomes the property of Sponsor and will not be returned. By participating in a Sweepstake, an Entrant agrees to release, discharge, indemnify, and hold harmless Sponsor and Released Parties from and against all claims and damages or liability arising in connection with an Entrant’s participation in a Sweepstake and/or the receipt or use of any prize awarded in a Sweepstake or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstake-related activity or participation in any Sweepstake.
MISCELLANEOUS:
Persons who tamper with or abuse any aspect of any Sweepstake or social media account, who act in an unsportsmanlike or disruptive manner, or who are in violation of these Terms, as solely determined by Sponsor, will be disqualified and any associated Entry will be void. Should any portion of a Sweepstake be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, proper play, or submission of an Entry, Sponsor reserves the right at its sole discretion to suspend, modify, or terminate the Sweepstake and, if terminated, at its discretion, select the Winner(s) from any eligible, non-suspect Entry received prior to action taken using the winner selection procedure outlined above.
NOTICE: ANY ATTEMPT TO DELIBERATELY DAMAGE THE INSTAGRAM ACCOUNT OR UNDERMINE THE LEGITIMATE OPERATION OF ANY SWEEPSTAKE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
